MOSBY’S NURSING SUITE SUPERHEROES OF NURSING CONTEST

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING.

CONTEST DESCRIPTION: The Mosby’s Nursing Suite Superheroes of Nursing Contest (the “Contest”) is a contest where participants are asked to nominate a person who is involved and active in a nursing role to be their Hero (“Nominated Hero”). The Contest begins at 12:00 PM (noon) Eastern Time (“ET”) on 5/1/12 and ends at 11:59 AM ET on 8/31/12 (“Contest Period”). The Contest consists of four (4) Monthly Periods, each broken up into three (3) Phases: Submission; Judging; and Public Voting (as defined below). Each Phase begins at 12:00 PM (noon) ET on the start date of the phase and ends at 11:59 AM ET on the end date of the phase.

ELIGIBILITY: The Contest is open only to legal residents of the fifty (50) United States and District of Columbia (U.S.) who are at least eighteen (18) years of age or the age of majority in his/her state of residence, whichever is older as of date of entry (“Entrant). Employees (and the immediate families [spouses and parents, in-laws, siblings and children and their respective spouses, regardless of where they reside] and members of the same household of such employees, (whether or not related) of Elsevier CDS (“Sponsor”), it’s parent, divisions, affiliates, dealers, subsidiaries and advertising and promotion agencies, including Atomicdust and Exposure Marketing & Promotions, Inc. and companies involved in the implementation and execution of the Contest (collectively, the “Contest Entities”) are not eligible to enter. Contest is subject to all applicable federal, state and/or local laws and regulations. Contest is void in Puerto Rico, and U.S. Territories and jurisdictions (including overseas military installations) and where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Contest, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, Judges and the Administrator which are final and binding on Entrants and Nominated Heroes in all matters related to the Contest. For Nominated Heroes – For the Contest Entry to be determined as a potential winner, the Nominated Hero, must be involved and active in a nursing position and must provide written consent to accept the nomination and fully and unconditionally agree to and abide by the Official Rules and the decisions of the Sponsor, Judges and the Administrator; and if judged to be the winner of the Contest. Failure to provide written consent within five days of receipt of notification may result in disqualification of the Contest Entry.

HOW TO ENTER THE CONTEST: Visit www.MosbysHeroes.com. (the “Website”) or the Mosby’s Nursing Suite Page on Facebook at www.facebook.com/MosbysNursingSuite during the Contest Period and a) agree to the Official Rules; b) complete the Official Hero Nomination Form; c) answer the essay question posted on the website, not to exceed 500 words, as to why the Nominated Hero fits the definition of being ‘a Hero in the field of nursing (“Contest Entry”) and d) submit as directed. ALL ENTRIES MUST BE RECEIVED BY 11:59 AM ET on the final day of the respective Entry Period. LIMIT: One (1) Contest Entry per Entrant or email address per Nominated Hero for the Contest Period. In the event more than one (1) Contest Entry is received from any one person or email address on behalf of the same Hero Nomination, the first Entry processed will be considered the only valid Entry received.

CONTEST ENTRY REQUIREMENTS: Contest Entries may not exceed 500 words and will be ineligible if they are corrupted, do not meet ALL of the specified requirements or are not able to be viewed due to technical or human error or reasons beyond the control of the Sponsor or the Judges. In addition, a Contest Entry shall be void in the sole discretion of the Sponsor or the Judges if it contains any product or service endorsement, or "commercial tie-ins", or any material deemed offensive, or which might subject Contest Entities to regulatory or legal action, violate any law, infringe the rights of any person, or could subject them to liability for any reason. Photos or videos uploaded along with Contest Essays will not be utilized in the judging process for determining the Finalists. By submitting a Contest Entry, Entrant represents and warrants that the Entry essay is (a) wholly original with the Entrant; (b) has not been previously submitted or distributed elsewhere for any other purpose and does not incorporate or include anything that is owned by any third party or would require the consent of any third party other than the Nominated Hero; and © does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party. Contest Entry becomes the permanent property of Sponsor, and Entrant and Nominated Hero to the extent necessary, irrevocably assign and transfer to Sponsor all rights in each essay, including without limitation, all copyrights. Sponsor shall have the right to use/edit the Entry in any manner in any and all media, worldwide in perpetuity without further compensation or consent. Upon request of Sponsor, Entrant and Nominated Hero as requested will provide written consent to the foregoing in a form provided by Sponsor.

DETERMINATION/VERIFICATION OF FINALISTS (JUDGING): Three (3) Monthly Finalists (each a Nominated Hero) will be determined from among all eligible Entries received within each of the four (4) Monthly Periods. Entries received during each Monthly Period will be judged equally based on the Contest Entry and rated on how well the Nominated Hero fits the qualities that are highlighted for the particular Contest Period. Judging of Entries and the determination of the Finalists will be completed by the final day of each Judging Period. The three (3) Nominated Heroes featured in the three (3) essays having received the highest total scores for that Monthly Period will be declared the Monthly Finalists for that Monthly Period (subject to verification of eligibility and compliance with the Official Rules). In the event of a tie between top scoring Entries at the conclusion of any Contest Period, the Entries involved will be re-judged by an additional Judge who will serve as a tiebreaker and who will evaluate Entries according to criteria listed above. Judging will be conducted under the supervision of Administrator, an independent judging organization. The Winning Nominated Hero and the Entrant who submitted the winning Entry will be notified by telephone and/or express mail to confirm eligibility. The Finalist will be required to complete and return, in his/her official capacity, an Affidavit of Eligibility and Liability Release and, unless prohibited by law, a Publicity Release (“Affidavit”) within forty-eight (48) hours of receipt. The affidavit of the Winning Nominated Hero will include an acceptance of the nomination. Failure to timely execute and return the required documents or the return of any notification as undeliverable may cause the prize award to be forfeited, at Sponsor’s sole discretion, and prize will be awarded to the Nominated Hero with the next highest score who will be required to complete and return the Affidavit.

DETERMINATION OF WINNERS (ONLINE VOTING): Entries for up to three (3) Finalists in each of the four (4) Monthly Periods will appear on the Website during the Online Voting Period. Votes may only be submitted online. All votes must be received by 11:59 AM ET on the final day of each of the Monthly Periods in order to be valid. The Finalist during each Monthly Period whose entry receives the greatest number of valid votes will be the potential Grand Prize winner for that Period. In the event of a tie, the entries involved in a tie will be reviewed by an additional judge appointed by the Sponsor, in its sole discretion, who will serve as a tie-breaker and who will evaluate the tied entries according to the judging criteria listed above.

FOUR (4) GRAND PRIZES: The following prize will be awarded to each of the four (4) Monthly Winners – A Trip for one (1) to the 2012 ANCC Magnet Conference in Los Angeles, CA from 10/9/12 through 10/12/12. Each trip consist of round-trip, coach air travel from the major commercial airport nearest winner’s residence to Los Angeles, CA; three (3) nights accommodations (room and tax based on single occupancy); conference admission and local transportation between airport, hotel and conference venue; and a $300 Gift Card (issuer to be selected by sponsor in its sole discretion; subject to terms/conditions indicated thereon). Approximate retail value (“ARV”) of each trip is $2,700 In the event that the winner resides within 200 miles of Los Angeles, CA, ground transportation may be provided in lieu of air travel.

GENERAL PRIZE RESTRICTIONS: Prizes will be awarded to the Nominee listed in the winning Entry. The Entrant does not win a prize. Prizes may not be transferred nor assigned. All expenses and costs related to acceptance and use of prize not expressly listed above are entirely the winner’s responsibility. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute the prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion. Winners will be responsible for all applicable taxes (not limited to federal, state local and/or income) and will be required to provide his/her Social Security number or tax ID for tax reporting purposes as Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the fair market value of prize. In the event that any potential Grand Prize winner is disqualified for any reason, that prize will be forfeited and awarded to an alternate. Once travel documents are issued, they may be not changed without the express approval of Sponsor, which may be withheld for any reason whatsoever. Actual value of prize may vary due to airfare fluctuations and departure location. Any difference between stated ARV and actual value will not be awarded. Sponsor shall not be responsible for any cancellation, delay, diversion or substitution, or any act or omission whatsoever by the air carrier, hotel, or transportation companies or any other person providing any of these services and accommodations, including but not limited to any change in services or accommodations necessitated by same. Sponsor not responsible for the postponement or cancellation of the 2012 ANCC Magnet Conference. In the event of postponement or cancellation of the 2012 ANCC Magnet Conference, Prize will be awarded without tickets to the Magnet Conference on the same itinerary (as determined by Sponsor) and no additional compensation will be provided.

GENERAL CONDITIONS / RELEASE: By participating, Entrants (a) release Contest Entities, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, but not limited to the prize quality or availability. Neither Contest Entities nor any service providers are responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or Website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this Contest. Any Entry will be void if altered, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, non-deliverable, tampered with, unauthorized or unintelligible. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Contest is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which in the opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any suspect Entry or Entrant and to cancel, terminate, modify or suspend the Contest. In the event of any cancellation, termination or suspension, notice thereof will be posted at www.confidenceconnected.com/MosbysHeroes and the determination of the Contest winner will be made per the specifics described in the CONTEST WINNER DETERMINATION section from among all eligible, non-suspect Contest Entries received as of the date of the termination, cancellation or suspension, as Sponsor determines in its sole discretion provided that in such circumstances Sponsor reserves the right not to award the Contest prize. Entries not complying with all rules are subject to disqualification. Except where prohibited by law, acceptance of prize constitutes permission for Sponsor to use the winner’s names, hometown, likeness, statements (where applicable) and other identifiable information for promotional, advertising and marketing purposes in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winners will provide written consent to such use.

SWEEPSTAKES DESCRIPTION / TIMING: From 12:00 AM Eastern Time (“ET”) on 5/4/12 through 11:59 PM ET 9/28/12 (“Promotion Window”), there will be twenty-one (21) weekly sweepstakes periods (each a “Weekly Sweepstakes”). A “Week” is defined as the seven (7) day period beginning at 12:00 AM ET on each Saturday and ending at 11:59 PM ET each Friday throughout the Promotion Window. Entry into each Weekly Sweepstakes is based upon your weekly participation, and entries from previous Weeks will not be carried into the next Week’s drawing.

(“Entrant”). Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Elsiever (“Sponsor”), Atomicdust, Exposure Marketing & Promotions, Inc., and their respective parent companies, subsidiaries and affiliates and companies involved in the implementation and execution of the Promotion (collectively the "Promotion Entities") are not eligible. Promotion is void in Puerto Rico and other US Commonwealths, Territories and jurisdictions (including overseas military installations) and where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Promotion. HOW TO ENTER: To submit an entry into a Weekly Sweepstakes, go online to www.facebook.com/mosbysnursingsuite (the “Website”) during the Promotion Window and “Like” the MOSBY’S NURSING SUITE page, if you have not already done so. Follow the on-screen instructions to register and participate in the Sweepstakes. Limit: One (1) entry per person or email address per Week. All entrants must have a valid e-mail address. Each entry is only eligible for inclusion in the Weekly Sweepstakes corresponding to the Week the entry was made. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not liable or responsible for late, invalid or misdirected entries, which will be disqualified. In the event of a dispute as to any entry received, the authorized account holder of the email address used to register will be deemed the Entrant. The authorized account holder of an email address is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Entrants are responsible for all charges imposed by their Internet service provider, including any applicable taxes on such services, in connection with submission of an entry. WEEKLY PRIZES: Up to ten (10) prizes awarded per each Weekly Sweepstakes (the “Weekly Prizes”), with a total of two hundred ten (210) Weekly Prizes during the Promotion Window. Each Weekly Prize winner will receive one (1) Mosby Nursing t-shirt. The Approximate Retail Value (“ARV”) of each prize is $15. The maximum total ARV of all Weekly Prizes each Week is $3,150.

WINNER SELECTION: Potential Weekly prize winners (up to ten [10] winners per Weekly Sweepstakes) will be selected in twenty-one (21) individual random drawings, each held approximately seven (7) days after the close of each Weekly Sweepstakes entry period, from all eligible entries received for that Week. Potential winners will be notified at the phone number or email address used to register for the Sweepstakes. Once a winner has been contacted, they will have ten (10) days from that date to respond with shipping information. If they do not respond within ten (10) days, Sponsor reserves the right to select an alternate winner in their place. Weekly Sweepstakes entries will NOT be carried over to the subsequent Weekly Sweepstakes. Odds of winning a Weekly Prize depend on the number of eligible entries received for each Weekly Sweepstakes.
